IndiSpark's Policy of Public:

Compliance and Enforcement:

  • 1.1 By buying, joining, or utilising anything IndiSpark: You agree to IndiSpark's Policy of Public and the associated license. Including this website.
    • 1.1.B: The terms “we”, “us”, "company", and “our” refer to the company IndiSpark (And any respective subsidaries). “You”, "User", "Member" and "Your" refer to you, as a user of our Site(s) or our Service(s).
    • 1.1.C: Contributing to anything IndiSpark/Brave Bot means you agree to this policy.
    • 1.1.D: IndiSpark reserves the right to take action against any violation(s) regardless of whether such violation(s) occurred/occur within or outside of IndiSpark's owned or operated areas, services, or platforms.
  • 1.2: Failure to comply may lead to administrative action. Violations of this policy are classified into three levels: Minor, Medium, and Major.
  • 1.3: We have the right to change this policy without notice.
  • 1.4: We may use third-party software to deliver our services. These third-party services may have their own policies; We therefore ask you to comply and agree.
  • 1.5: The company handles reports of all matters through a confidential, lengthy, non-biased inquiry & review process.
    • 1.5.B: The company's handling of reports is unbiased and gives its sole judgement to each report after the review & inquiry process.
  • 1.6: The Terms stated below do not affect your statutory rights or your legal rights, if any, as a consumer/customer.
  • 1.7: The Terms stated below represent the entire agreement between you and us in connection with your use of the Services, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and the Company with respect to the Services.
    • 1.7. This policy is associated with the GPL 3.0 License. Only the GPL V3.0 License can supersede this policy/agreement. ANY OTHER AGREEMENT THAT STATES SUCH IS VOID AND INVALID. The GPL 3.0 License can only supersede this license if there is a conflict.
  • 1.8: This agreement/policy is governed by the laws of the United Kingdom without regard to conflict of law provisions.
  • 1.9: If any section of this agreement/policy is found invalid, the remaining sections will remain in effect.

Privacy:

  • 2.1: The company does not collect or store any data or data objects without your consent.
  • 2.2: We are subject to the UK's version of GDPR. All of our services are subject to and bound by GDPR and all other privacy-related laws/regulation. Please refer to Section 1 for further information regarding governing law.
  • 2.3: We collect and process your data to ensure our services function properly and gives you the best experience possible. Here is how we use the data we collect/process: Please know that this data can only be accessed by our lead-developer (Jeremy D'Sa)*.
    • 2.3.B: When creating a Topia Profile you agree to your Discord User ID and Coin Balance (upon profile creation it is set to 0) to be stored on our server's. Profile creation is done manually by the user. We provide the option for the user to delete their profile at any time via a dedicated profile management command.
    • 2.3.C: When acquiring Brave Bot Pro for youself you agree to your Discord User ID being stored on our server's. When acquiring Brave Bot Pro for your server you agree to your Discord Server's ID being stored on our server. This is explictlly mentioned when you apply and acquire Brave Bot Pro.
    • 2.3.D: When encountering an error we use GitLab's Integrated Error Tracking. The system logs the error and your Discord User-ID for 90 days.
      • The Error Tracking Page for Brave Bot on GitLab is made private. Only the main developer (Jeremy D'Sa) can access it at anytime.
  • Note: IndiSpark uses DigitalOcean & GitLab to host services we provide on any scale.

Behaviour:

  • 3.1: Treat all volunteers, users and members of our community with dignity, empathy and respect. Regardless of their backgroud, identity, beliefs or any other characteristic.
    • 3.1.B: You agree to help create and maintain an environment that is welcoming, kind, generous, inclusive of all and accessible to all.
    • 3.1.C: It is forbidden to be prejudice or exclusionary to anyone in any way.
    • 3.1.D: You agree to always report violations of this policy to a member of the (IndiSpark) Team without hesitation or delay.
  • 3.2: It is forbidden to engage in harassment, descrimination or bullying of any kind.
    • 3.2.B: It is also forbidden to do unwanted advances, stalking or other abusive relantionship behaviours.
    • 3.2.C: The act of targeted hate is also forbidden.
  • 3.3: Be honest and always give accurate & truthful information in any interaction you free willingly do.
    • 3.3.B: It is forbidden to lie, troll, mislead, manipulate or descieve people.
  • 3.4: Respect intellectual property owned by anyone. It is forbidden to infringe someone's rights or engage in plagiarism.
    • 3.4.B: It is also forbidden to engage in copyright infringement(s).
  • 3.5: Respect peoples rights, privacy, personal space and personal information.
    • 3.5.B: It is forbidden to leak someone's private information/data.
    • 3.5.C: You also agree to protect other people's privacy and rights.
  • 3.6: You agree to follow/abide all applicable laws & regulation.
    • 3.6.B: You also recongise and acknowledge that this policy is goverened by laws and regulations made by the Government of the United Kingdom.
  • 3.7: While using Brave Bot's Topia System you agree to the following Topia Rules:
    1. Any actions performed to gain an unfair advantage over other users are prohibted. This includes but not limited to:
      1. Using macros/scripts for any Topia command.
      2. Using multiple accounts for any reason(s).
    2. Using an expliot or any reported / un-reported bug to gain an unfair advantage/lead.
      1. You are not in violation of this rule. If you find a bug, report it and proceed not to exploit it afterwards.
    3. You can not sell or give Topia Coins for anything outside of this bot.
      1. Conducting a giveaway of Topian Coins is permitted. Given all local & international laws & regulations are followed.
      2. Asking users to give real-life money to enter a giveaway is strictly forbidden as Topia Coins do not have a real-life value.
      3. Asking users to give real-life money to get Topia-Coins is strictly forbidden as Topia Coins do not have a real life value.

Our & Your rights:

  • 4.1: We have the rights to the names: "JEZZADJ", "IndiSpark" & "Brave Bot". And under no circumstances you are allowed to modify/recreate these IPs for any purpose/reason without explict and written permission from IndiSpark.
    • 4.1.B: You acknowledge and agree that we and our licensors retain ownership of all intellectual property rights of any kind.
    • 4.1.C: The logos and branding of IndiSpark and all respective subsiadries are owned by the Community.
  • 4.2 You have the right to appeal against any action by the company via a civil court or via the Appeal System. Can only can be done within 2 Months of said action.
  • 4.3: You do not have the right to recreate, edit or modify our content unless you have explict permission.
  • 4.4: When purchasing a service or product from the company. You have the right to be right when reporting an issue/defect with your order.
    • 4.4.B: The Right to be Right is applicable when you are seeking a refund (a resolution to a dispute) from us. The right gives you the power to say "im right" and denies us the right to deny you a refund unless the refund/dispuite is not policy abiding. Refer to our Refunds Section for more information regarding refunds, compensation or etc.
  • 4.5: We have the right to terminate your account/profile at anytime without reason. Termination can only be done if you have violated this policy/agreement. As stated in 4.2 you have the right to appeal any action we take aganist you.
  • 4.6: Suspension of your Topia Profile or Brave Bot Pro Membership can occur without notice/warning. Violations committed by you regardless of when gives us the right to terminate your account/profile.
    • 4.6.B: Upon suspension of your Topia Profile your Discord User ID and Coin Balance is not removed from our database(s). If your appeal is successful we are obligated to un-suspened your Topia Profile/Pro Membership.
    • 4.6.C: Your Brave Bot Pro Membership is a lifetime (forever) subscription that you can acquire. You agree to this policy when attempting to acquire such membership. If accquired you are required to adhere to this policy at all times.
    • 4.6.D: As stated in 4.2 you can appeal any suspension within 2 Months. Within this time of appeal you are granted temporary access to services that you may have been suspended from. The temporary access is subject to our approval.
  • 4.7: You are never granted the right to tamper with evidence when being investigated.
  • 4.8: You have the right to access the source code of all our software (including the commits, differences and release notes). Also applicable for the Policy of Public.
    • 4.98.B: Community members are encouraged to provide feedback, report issues, and propose changes to this policy. Please follow our Contributor Guide.

Volunteering at IndiSpark:

  • 5.1: This section only applies to IndiSpark Volunteers.
  • 5.3: If you are a volunteer at this company you must contribute at least once every year (365 days).
  • 5.4: No contribution should be done with the help of AI.
    • 5.4.B: No contribution should also be fully done/generated by AI.
    • 5.4.C: Using GitLab's Duo AI is allowed and therefore exempt from 5.4.
  • 5.5: "Uncivil" or "Coversive" dating is forbidden between Team Members.
    • 5.5.B: Drity flirting/talk is also forbidden in communal Team areas.
      • This is applicable to all team members.
  • 5.6: The company resveres the right to investigate the behaviour of volunteers on our platform(s) or service(s) that IndiSpark provides.
    • 5.6.B: IndiSpark also holds the right to publish/release these findings to the general public. IndiSpark will always publish/release a press release when an investigation has started (who & why will be publicly revealed). The company will also release/publish its findings and conclusions to the public, with private data being redacted. Evidence that validates/supports/confirms the accusation(s) is an actual breach of this agreement/violation of this policy, will also be published/released to the general public. Evidence that does not support/validate/confirm the accusation(s) will also be published/released to the general public.

Technology:

  • 6.1: It is compulsory that all software made by IndiSpark is open source.
  • 6.2: Any code, software, project or etc we open source is subject to the GPL 3.0 Open Source License unless stated elsewhere. Click Here to view
  • 6.3: Contribution to any IndiSpark Project via GitLab requires you to acknowledge: That you take full responsibility for the edits, deletions or additions you make.
  • 6.4: You are to follow this policy when contributing to any IndiSpark Project (via GitLab). Alongside following GitLab's Policies.
  • 6.5: Upon any attempt to contribute to any IndiSpark Project (via GitLab). You take on the duty to ensure the contribution improves the user expirence, fixes bug(s), adds user wanted features or etc. Failure to take on or carry out such duty may result in adminstrative action.
  • 6.6: IndiSpark's GitLab Area governance is democratic and independent from the rest of the company's governance and structure. The CEO has no control or executive power over what is approved or disapproved.
  • 6.7: 3 people are elected every 4 years as Directors of Open Source Software & R&D.
    • 6.7.B: Elections are carried out in a secure, independent manner (The three present Directors have no right or authority to interfere with the election). Campaigning is also strictly forbidden.
    • 6.7.C: Elections are to be monitored by IndiSpark, but no one can intervene or attempt to alter the results. Results are counted and announced by the IndiSpark's Development Oversight Board.
  • 6.8: The IndiSpark Development Oversight Board (IDOB) has 7 Board Members. Each director appoints 2 board members at the start of their term. The CEO also appoints 1 board member when a new term starts. Board Members can only be given this position once and can only be retained for 1 term (4 Years).  
    • 6.8.B: The IDOB is bound to the community to ensure the community is heard. Failure to do so grants the right for the community to "Disband the Board & Directors".
  • 6.9: "Disbandment of the Board & Directors" is done when there are large protests throughout IndiSpark's community areas and development areas or when there is little / no trust in the board and directors.
    • 6.9.B: The Board & Directors are required to hold an election within 2 weeks of such protests.
  • Note: The Directors & Board do not hold the right to carry out adminstrative action for Policy of Public Violations.

Community Guidelines:

  • 7.1: Any community areas that allows our community interact with our Team or with each other are subject to following guidelines.
    • 7.1.B: All community areas are moderated by members of the IndiSpark Team and by Community Volunteers.
    • 7.1.C: All community areas are required to follow this policy and any other Community Guidelines outlined in this section.
    • 7.1.D: This section is only applicable in Community areas.
  • 7.2: All community areas allows freedom of speech but also prohibits the following:
    1. Any rape joke(s).
    2. NSFW, sexual content or etc.
    3. Nazi belief talk.
    4. Discrimination (Refer to section 3 regarding Behaviour).
    5. Any self-harm, suicide related joke(s).
    6. Slurs or Inflammatory Language.
    7. Rudeness towards any Community Member(s) or Team Member(s).
    8. Online dating or online flirting.
  • 7.3: Promoting suicide or etc to any member of the IndiSpark Community is strictly forbidden.
    • 7.3.B: If you have sucidial thoughts or seek to do self harm. Please use the various tools provided like: /vent & /seek-help to get the nesccary help.
    • 7.3.C: Action is not permitted if you are suffering or having self-harm thoughts or suicidal thoughts. This is limited to only small violations of the PoP (Policy of Public). Violations deemed "Large" permit the Volunteer to take action aganist you. The Volunteer should also consider the impacts of this on their mental health. The impacts it could have should always be considered before taking action.
  • 7.4: IndiSpark's Community areas should be peaceful, with respect given to all. With toxicity, rudeness, discrimination, targeted hate, uncivil behaviour, and bullying all strictly forbidden.

Refunds:

  • 8.1: Refunds are referred to as "Disputes" for this section only.
  • 8.2: Disputes are handled via Stripe.io (A Third Party Service) or through direct communication with our Team (Via Email or Discord).
  • 8.3: Cancelling a order of any Product or Service does not entitle you to a refund of any amount.
    • 8.3.B: If we cancel your order (Product Order not Service Order) it is within our discretion to decide weather a refund should be given. Mass-Cancellations do require IndiSpark to transact full refunds.
  • 8.4: If a fault has occured with a product (tangible item) you have ordered, and you have reported this fault within 14 days and is within your 6 month product warranty. You can claim a full refund.
    • 8.4.B: If a fault has occured with a service (none-tangible product) we provde you with. Then we are not required to give a refund of any amount. We may provide you with some compensation but we are not obligated to by Law and by our Limitation of Liability (Read Section 10).
    • 8.4.C: Asking for a refund of a donation can only be done within 14 days of such donation being processed.
    • 8.4.D: If the donation was used to acquire a Brave Bot Pro Membership. Then the associated membership will be terminated/revoked.
  • 8.5: If you have the legal right to claim compensation or a refund from us (IndiSpark) please contact us.
  • 8.6: You can demonstrate your Right to be Right when claiming compensation or a refund. (Refer to 4.6 about your Right to be Right).
  • 8.7: Lying to gain a refund or compensation is forbidden.
  • 8.8: The company resveres the right to decline (not take action) on ANY dispute unless legally obligated to.

Modern Slavery Act:

  • 9.1: This section of the Policy Of Public is made in compilance to section 54 of the Modern Slavery Act 2015 (UK).
  • 9.2: When joining this company you join as a Volunteer. Nothing can/will/should stop you from leaving this company as a volunteer. This company has one employee and thats is it's CEO.
  • 9.3: We do not force people to do any work within the company. But it is understood when joining as a volunteer you will help out whenever and wherever you can.
    • 9.3.B: Saying you can't do work is allowed and is understandable.
  • 9.4: We do have Work standards and when volunteering you must follow these standards or face the possiblity of dismissal.
  • 9.5: If a Volunteer suspects Slavery is being conducted within our company please report it and ensure justice is served.
    • 9.5.B: Use of none-violent force to stop slavery within our workspace is granted to all of volunteers. Violent force is only permitted if local police/authorities approve of it.

Limitation of Liability:

  • 10.1: The Company does not make any warranty about the reliability of the Services or the security of user data, despite best efforts. The Service is provided “as is” and “as available,” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, or warranties that may arise from course of dealing or course of performance or usage of trade.
  • 10.2: To the extent not prohibited by law, you acknowledge and agree that in no event will the Company be responsible or liable to you or any third party, under any theory of responsibility or liability, for any indirect, special, exemplary, incidental, consequential, or punitive damages (including, but not limited to, procurement of substitute goods or services; loss of data, use, or profits; business interruptions; or any other damages or losses), for any multiplier on or increase to damages, or for any costs or fees (including attorneys’ fees), whether under these Terms or otherwise.
  • 10.3: Applicable law in some locations, such as the State of New Jersey, does not allow the waiver of implied warranties, the limitation of liability of certain damages set forth above, including the provisions of this section that limit or exclude special, exemplary, consequential, or punitive damages, or limit or exclude the use of any multiplier on or increase to damages, and limit the liability of the Company or any of the Company’s parties, to the greater of either $100 or the amount paid by you for use of your Account or the Services. These limitations or exclusions may not apply to you. The provisions of this section do not apply to the extent, and only to the extent, not permitted by applicable law.
  • 10.4: IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE § 1542, WHICH SAYS: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
  • 10.5: When using our software you agree to it's respective license (GPL V3). Which has its own section regarding Liability.

  • The words: "Forbidden", "Prohbited" or the pharse "Not Allowed" means if you do such thing you have broken this policy and could face adminstative action from the IndiSpark Team.
  • Adminstrative Action means you could be banned from anything related to the company. And if you are apart of the IndiSpark Team you could face being fired or suspended.

If the violation is unsupported by enough accurate or creidtable evidence. The violation will fall into the Medium Level. Unless it is a violation that violates UK laws and requires police referral, then it falls into the Major Level. If there is no evidence or no creidtable evidence, no action should be taken and will not fall into any level (If deemed needed, IndiSpark may refer the violation to the Police).

Minor Level:

The violation is minor/small. The following actions are permitted:

  1. A verbal/formal warning.
  2. Temporary suspension from talking in a/all online-area(s). (Not a removal)
  3. Removal from a/all community area(s).
  4. A indefinite ban from a/all community area(s).
  5. Suspension as Volunteer for 6 Months.
  6. A time-specific ban from a/all community area(s).
  7. Suspension of their Topia Profile.

Medium Level:

The violation of policy is substantial. Requries direct and consequential action. Suspension for 6 - 24 Months or Dismissal if they are a Volunteer. If they are not a Volunteer, banned from all socials (including IndiSpark managed Community Areas and IndiSpark Events) for life.

Major Level:

The violation is illegal and requires police referral. Immediate dismissal if they are a Volunteer. Lifetime ban from Socials (This includes IndiSpark managed Community Areas and IndiSpark Events). And refferal to the UK Police.
